Samantha Peterson

Samantha’s core practice is in commercial litigation and dispute resolution. She has over 20 years’ experience across all jurisdictions in New South Wales, Queensland and England where she is also fully qualified.

Corporations and general equity matters including injunctive relief, contractual and property disputes involving complex facts and issues, insolvency, breaches of directors’ duties claims and shareholder disputes are her main focus. Professional negligence cases involving valuers, accountants and financial planners also strongly feature in Samantha’s practice. In England she had success in reported cases in the Court of Appeal over leasing matters.

Referrals are an important source of her work, a key outcome of establishing good relationships with clients and delivering savvy and outstanding work. Samantha has extensive experience advising both Plaintiffs and Defendants in commercial disputes including identifying strategies to achieve commercial results.

Samantha also has extensive experience in a wide range of employment disputes, assisting both employers and employees, in all areas of employment law including unfair dismissals, general protections, anti-bullying and breach of contract. Samantha also conducts independent workplace investigations for employers.

Samantha’s work in equity and trusts has included acting for the commercial trustees in complex Supreme Court proceedings, involving managed investment schemes, a leading Australian investment bank and foreign law issues. Samantha has also run a successful multi-million dollar dispute in the Supreme Court in relation to fraud and conversion claims against a major Australian bank.

Samantha has acted for a client in a Commonwealth Operation Wickenby tax prosecution. She acted for a property developer in Supreme Court proceedings over a multi-million dollar deadlocked joint venture project. Other legal work for clients has included professional negligence claims against financial advisers, general estate disputes, the defence of a medical-negligence class action and a contested family provision claim in a multi-party litigation in an estate valued at more than $2 billion.
